Terms of Service
These terms explain how you can use Outstalk across the product, talent marketplace, managed outbound services, and training programs.

1. Using Outstalk
Outstalk provides cold calling software, lead workflows, CRM-related tools, campaign management, a freelance cold caller marketplace, done-for-you outbound services, and training programs. By accessing or using Outstalk, you agree to these Terms.
If you use Outstalk on behalf of a company, you confirm that you are authorized to accept these Terms for that company.
2. Accounts and access
You are responsible for the accuracy of your account information, the security of your login credentials, and all activity under your account.
You may not share access in a way that avoids seat limits, misrepresents users, or creates security risk for customer, lead, or campaign data.
3. Calling, leads, and compliance
You are responsible for making sure your outbound campaigns comply with laws and rules that apply to your business, targets, geography, industry, and communication channel.
You may not use Outstalk for unlawful, deceptive, abusive, harassing, discriminatory, or spam-like outreach. You must respect opt-outs, do-not-call requirements, consent requirements, and applicable telemarketing rules.
Lead enrichment and contact data tools are provided to support lawful B2B outreach. You remain responsible for how you use, verify, store, export, and contact leads.
4. Talent marketplace and agency services
Outstalk may help companies find vetted freelance cold callers or managed callers. Talent profiles, availability, rates, experience, and outcomes are provided to help matching, but they are not guarantees of future performance.
When you hire or work with talent through Outstalk, you agree to provide accurate campaign briefs, reasonable instructions, lawful calling targets, and timely feedback.
For done-for-you or managed services, specific pricing, deliverables, payment terms, and qualification criteria may be described on the relevant service page, order, or written agreement.
5. Payments and subscriptions
Paid plans, marketplace engagements, agency services, training programs, setup fees, and usage-based charges may be billed through third-party payment processors such as Stripe.
Unless a specific written agreement says otherwise, fees are non-refundable once access, setup work, training, or services have started. Taxes, payment processor fees, and currency conversions may apply.
6. Customer data and integrations
You keep ownership of your customer data, leads, CRM data, scripts, notes, and campaign content. You grant Outstalk the rights needed to host, process, display, transmit, and support that data so the service can work.
If you connect third-party tools such as CRMs, calling providers, enrichment providers, calendars, or payment processors, their own terms and privacy practices also apply.
7. Intellectual property
Outstalk, including the software, design, workflows, branding, content, and underlying technology, is owned by Outstalk or its licensors.
You may not copy, resell, reverse engineer, scrape, or misuse the platform except as permitted by these Terms or a written agreement.
8. Availability and disclaimers
We work to keep Outstalk reliable, but we do not guarantee uninterrupted availability, specific sales outcomes, booked meetings, revenue, connect rates, or performance from any campaign or caller.
Outstalk is provided on an as-is and as-available basis to the fullest extent allowed by law.
9. Termination
You may stop using Outstalk at any time. We may suspend or terminate access if you violate these Terms, create risk for the platform or other users, fail to pay, or use the service unlawfully.
After termination, we may retain certain data as required for legal, security, billing, fraud prevention, backup, or legitimate business purposes.
